After the Verdict

Civil cases, police accountability, and what remains unresolved.

The criminal verdict did not end every legal dispute. Here we follow the family's civil case, Read's lawsuits, the witnesses' claims and police accountability. John O'Keefe's death remains the reason these proceedings matter.

A complaint is an allegation. A discovery order requires a step in the case; it does not decide whose account is true. Civil liability and criminal guilt are different questions. Our interpretation remains separate from both.

The O'Keefe family's wrongful-death case

The family is pursuing a civil case against Read and the businesses behind C.F. McCarthy's and the Waterfall. It has not reached the scheduled trial.

Summary-judgment hearing: November 24, 2026, 10 a.m. Trial scheduled: April 5, 2027, 9 a.m. Local court time; dates may change.

October 28, 2026

The August 2024 complaint alleges that Read caused John's death and that the bars bear responsibility for serving her alcohol. Those are the family's claims, not findings made by this lawsuit.

A September 15, 2026 scheduling order sets the next major dates. Summary judgment asks the judge whether claims can be decided without a trial; the scheduled hearing does not tell us how the judge will rule.

Civil claims generally use a different burden from criminal charges: more likely true than not, rather than proof beyond a reasonable doubt. The death-related acquittals remain the criminal outcome. They do not themselves resolve this civil case.

Our interpretation

We see this case as a separate forum for testing responsibility for John's death. We will examine the evidence it produces; the family's decision to sue is not additional proof of a collision.

What this does not establish: There is no civil verdict in the docket we checked. A scheduled trial is not a promised date or a finding of liability. We have not independently reviewed every discovery filing.

Read's lawsuit against investigators and witnesses

Read's claims against individual investigators and civilian witnesses are being litigated separately in federal court. The public mirror we checked is incomplete as a current-status source.

The case reached federal court by removal on November 25, 2025. The docket later records an amended complaint, answers and motions challenging whether claims should proceed.

At the July 14 hearing, Judge Denise Casper took the operative dismissal motions under advisement. Earlier motions were denied as moot because the complaint had changed. That procedural disposition should not be described as a merits victory for either side.

Our interpretation

We will test Read's civil allegations against the evidence with the same care we apply to the family's claims. Filing a lawsuit does not establish a cover-up, and seeking dismissal does not establish that every factual allegation is false.

What this does not establish: CourtListener's RECAP copy may lag. We cannot infer that nothing has happened since July 14, or describe the current federal outcome as settled from this mirror.

Proctor's misconduct and professional accountability

The POST Commission issued a suspension of Michael Proctor's police certification in December 2025. That official action belongs alongside the documented misconduct already discussed in our evidence review.

December 18, 2025 order verified. Later disciplinary disposition not independently confirmed.
Checked
October 28, 2026

The order suspended Proctor's certification effective on receipt and barred police duties while the suspension remained in effect. It provided for a hearing and said the suspension would continue until a final decision or revocation of the order.

This is a professional-discipline action. It is not a ruling that Proctor planted taillight evidence or concealed a killing, and we do not describe it as permanent decertification.

Our interpretation

We regard the misconduct as serious and relevant to confidence in the investigation. That judgment does not let us skip the separate question of what evidence supports a specific planting allegation.

What this does not establish: The order supports the fact of suspension and its stated terms. It does not settle disputed evidence handling or prove or disprove a cover-up. Our earlier misconduct assessment is in record E34.

Witnesses' claims against Read and Kearney

Jennifer McCabe, Brian Albert, Colin Albert and Brian Higgins sued Read and Aidan Kearney over statements and conduct they allege harmed them. The case remains contested.

October 27, 2026: court ordered a response to a document subpoena within ten days.
Checked
October 28, 2026

The original April 16 complaint alleges defamation and harassment connected with accusations that the plaintiffs were involved in John's death or in framing Read. The Plymouth docket later records answers to an amended complaint and ongoing appellate activity.

On October 27, the court allowed a motion to compel nonparty attorney David Yannetti to respond to an August 6 document subpoena within ten days. This is a discovery order: it requires a response in the litigation. It is not a finding that any party lied or is liable.

Our interpretation

These claims matter because public accusations have consequences for the people named. We will keep that concern separate from the evidence about how John died; neither side gains factual credibility simply by suing or being sued.

What this does not establish: The original complaint is not the later amended pleading. The docket summary does not establish the contents of private discovery or resolve privilege questions, truth, damages or liability.

Read's separate case against the agencies

Read also sued the Massachusetts State Police and the Town of Canton. This is a separate state case from her federal claims against individuals.

October 16, 2026: Rule 12 hearing held; matter taken under advisement. No later ruling displayed at our check.

October 28, 2026

NBC Boston reported the new filing in June 2026 and attributed allegations of investigative misconduct to Read. Those allegations are disputed claims, not findings we adopt.

The case moved from Bristol Superior Court to Plymouth in September. The docket records an October 16 hearing on a Rule 12 motion, a challenge addressed before a trial on the merits. The judge took the matter under advisement.

Our interpretation

An agency lawsuit can raise questions that differ from whether a particular person struck John. We will report verified rulings on their own terms and avoid treating every procedural step as proof for either narrative.

What this does not establish: Our current-status account comes from the docket, while the initial allegations are summarized from reporting. We have not authenticated the full operative pleading or reviewed all submissions.
