Messages were admitted through a recipient, with a limitation tied to the investigator's state of mind.
What the record shows
Jonathan Diamandis, Proctor's childhood friend, authenticated messages containing derogatory comments about Read and early conclusions about the case.
Diamandis said Proctor had not told him he planted or tampered with evidence or framed Read. The court permitted the messages to be introduced through Diamandis without requiring the defense to call Proctor.
Limits and disputed context
The admitted messages and the witness's answers are reported separately. The messages do not amount to a judicial finding that physical evidence was fabricated.
How we assess Proctor's conduct
We distinguish documented misconduct from allegations of evidence planting or a cover-up.
Why we give this weight
Proctor's degrading messages about Read were unacceptable. The early conclusions reflected in them also give us reason to question his impartiality and examine his investigative decisions closely.
The material we have reviewed does not establish that Proctor planted evidence or covered up another person's crime. His messages demonstrate misconduct. Proving those other allegations would require evidence of those actions, not just his hostility toward Read.
The material challenge
The defense challenged Proctor's proximity to the SUV in the corrected sallyport video, later fragment recoveries, and their documentation. Those concerns deserve examination alongside the messages.
Diamandis testified that Proctor had not told him he planted or tampered with evidence or framed Read. That answer does not establish that no such conduct occurred.
Our response
We look at the custody records and recovery accounts as well as the messages. Bukhenik said he and Proctor followed the tow truck without a Fairview detour, stayed at the station during the first taillight discovery, and exchanged no items there. That account matters to us, but it is witness testimony, not an independent recording of everyone's access or the later searches.
What we are not claiming
This is our assessment of the cited reporting, not a finding that no contrary evidence exists or an official exoneration. It does not excuse Proctor's conduct, certify every investigative step, or resolve undocumented activity. We will revisit it if further verified evidence changes the assessment.
Claims connected to this record
We examine defense arguments and broader inferences separately. Each heading is a paraphrase of the proposition being tested, not a quotation or a finding. The source account comes first; our reasoning is labeled. Missing evidence is not automatically evidence that an event could not happen.
These claim assessments cover the criminal trials through June 18, 2025. Later proceedings are covered separately in After the Verdict. These are selected assessments, not an exhaustive trial record. Most sources are trial reporting; a passage check does not authenticate original evidence. Several reports may describe the same testimony, and measurements from one phone are not independent witnesses. Rejecting a proposed cover-up mechanism does not establish a collision or guilt.
Proctor's misconduct establishes that he planted evidence
Inference from documented misconduct to a specific unproved act.
Why the claim is raised
Proctor's inappropriate communications and disciplinary firing raise legitimate questions about credibility and investigative reliability.
Strongest evidence or missing support
Those findings do not themselves identify an act of planting. A specific allegation still needs evidence of access, transfer, alteration or a false recovery account.
Our reasoning
We condemn the misconduct and scrutinize the investigation. We do not treat bad conduct as a substitute for establishing how a particular item was planted.
Limits and strongest remaining objection
This is not blanket exoneration. An absence of confession proves little, and circumstantial evidence can matter. Each custody problem needs its own assessment.
